Although no immediate changes are required, Kairos is addressing three common posting and notification questions received since the release of Executive Order (EO) 14173, “Ending Illegal Discrimination and Restoring Merit-Based Opportunity”.

If you are a state contractor or subcontractor, please contact Kairos regarding potential state-level affirmative action requirements before making any of the optional changes described below.

1. Do I need to update my EO tagline used in job postings and advertisements?

Not yet. EO 14173 permits continued use of the current EO tagline through April 21, 2025. The Department of Labor may issue updated language before this deadline, requiring revisions. The following taglines, commonly used by Kairos clients, reference only equal employment opportunity and remain compliant:

    • “All qualified applicants will receive consideration for employment without regard to race, color, religion, sex, sexual orientation, gender identity, national origin, disability, or status as a protected veteran.”
    • “Equal Employment Opportunity/disability/protected veteran status”

2. Do I need to update my Equal Employment Opportunity (EEO) Policy Statement?

Not yet. EO 14173 permits continued use of the current EEO policy through April 21, 2025. The Department of Labor may issue updated language before this deadline, requiring revisions. If you choose to remove references to affirmative action pursuant to EO 11246 from your EEO policy now, we recommend using the updated policy found in our Client Portal.

 3. Do I need to update my Equal Opportunity (EO) Clause in contracts and purchase orders?

Not yet. EO 14173 allows continued use of the current EO clause through April 21, 2025. The Department of Labor may release updated language before this deadline that necessitates changes. If you choose to remove references to affirmative action pursuant to EO 11246 from your EO clause now, please use the updated clause found in our Client Portal.
