Illinois Equal Pay Act (IEPA)
Equal Pay Registration Certificate
Expert Guidance for Illinois Equal Pay Act (IEPA) – Equal Pay Registration Compliance
Illinois requires specific pay data reporting for all private employers with 100 or more employees in the state. The Illinois Department of Labor (IDOL) requires employers to submit demographic and wage data to IDOL, along with a filed Annual Employer Information Report EEO-1 and an Equal Pay Compliance Statement certifying that, among other things, the average compensation for its female and minority employees is not consistently below the average compensation for its male and non-minority employees.
Submission Timeline
New or existing businesses that exceed 100 employees on December 31 of the most recent year are required to obtain an Equal Pay Registration Certificate (EPRC).
Employers generally have 120 days to submit the EPRC application and fee from the date of notice.
After receiving an initial EPRC, businesses are required to recertify every two years.
Who to Include
Illinois employees are the individuals who worked at your factory/facility/office in Illinois plus the 100% remote employees who report directly to Illinois management.
All employees during the 12-month calendar year immediately prior to the original deadline date or recertification due date should be included.
Submission Data
All employees from the prior year should be reported by gender and race/ethnicity categories as reported in the business’s most recently filed EEO-1 Report. Employee data should also include: wages paid in previous calendar year, hire dates, termination dates, job titles, EEO-1 job classifications, hours worked, and employee county.
